Breathing in Confinement: By the order of the Headquarters for Implementation of the Imam’s Decree, a new case has been opened against Maryam Akbari Monfared, a political prisoner locked up in Semnan prison. This headquarters has requested to confiscate and possession of the properties of Mrs. Akbari Monfared and her relatives.
According to “Breathing in Confinement” quoting Shargh, a new case has been filed against Maryam Akbari Monfared, a political prisoner imprisoned in Semnan prison, by the Headquarters for Implementation of the Imam’s Decree.
The lawyer Maryam Akbari Monfared announced the filing of a case against his client in the Revolutionary Court. According to Mr. Taj, this case has been opened by the Headquarters for Implementation of the Imam’s Decree against this political prisoner, and this headquarters requested the seizure and possession of the property of Mrs. Akbari Monfared and her relatives.
In an interview with Shargh, Ms. Akbari’s lawyer Hossein Taj stated: “In October of this year, Ms. Akbari Monfared’s 15-year imprisonment in the first case will end. During this time, she has not taken a single day off. Ms. Akbari Monfared has also been sentenced to 2 years in prison for another case. Recently, a new case has been filed against her, based on the request of the Headquarters for Implementation of the Imam’s Decree under the Article 49 of the Constitution.
Mr Taj added: “In the claim presented by this headquarters, some acts have been attributed to Mrs. Akbari Monfared and her relatives. And this headquarters has requested the confiscation and possession of the properties of the Akbari Monfared family for the benefit of the “Headquarters for Implementation of the Imam’s Decree”. This case has been referred to the 6th branch of the Revolutionary Court, this branch is specialized in dealing with cases related to Article 49 of the Constitution. “The time of handling this case has not been determined yet, and the investigation time has been set for the month of August.”
While referring to the jurisprudential and legal principle of “the personal nature of crimes and punishments”, he said: “The principle of the personal nature of crimes and punishments, which is recognized both in jurisprudence and Shariah, as well as in international law and the Iranian Penal Code, emphasizes that punishment should only be applied to the individual and not include their relatives. For this reason, we hope that the respected branch will not accept the case raised by the headquarters under the Article 49 of the Constitution and to reject it.
In March 2021, after 12 years of imprisonment, Maryam Akbari was deported from Evin prison to Semnan prison.
After being deported to Semnan prison, Maryam has been denied the right to call his relatives and he is only allowed to call then in the presence of a prison guard.
It should be noted that Maryam Akbari Monfared was detained by the security forces of the Ministry of Intelligence since January 2010 and was sentenced to 15 years in prison in an unfair trial by Branch 15 of the Revolutionary Court headed by Judge Salavati on charges of “Moharebeh” (waging war against God).
