Supreme Court rejects Haidar Ghorbani’s request for retrial

Breathing in Confinement: Branch 27 of the Supreme Court rejected Haidar Ghorbani’s request for the application of Article 477 of the Code of Criminal Procedure. Mr. Ghorbani is a political prisoner who has been sentenced to death.

 

According to Breathing in Confinement, the news organ of the Prisoners’ Rights League in Iran, Branch 27 of the Supreme Court rejected Haidar Ghorbani’s request for the application of Article 477 of the Code of Criminal Procedure. Mr. Ghorbani has been sentenced to death by the Revolutionary Court in Sanandaj, on charge of “armed rebellion against the Islamic ruler”.

 

According to Saleh Nikbakht, Mr/ Ghorbani’s lawyer, after his request for retrial was rejected in Supreme Court, the case was sent from the Revolutionary Court of Sanandaj to the Sentence Execution Branch of the Kamyaran Court.

 

Mr. Nikbakht emphasized that he would apply for retrial again and denied the charge of “armed rebellion against the Islamic ruler” against Haidar Ghorbani.

 

Haidar Ghorbani, a Kurdish political prisoner from the City of Kamyaran who has been sentenced to death, was arrested on October 11, 2016. The security forces accused him of being involved in the “assassination” of several government agents.

 

In March 2017, the English-language Press TV in a documentary named “Driver of Death” aired the forced confessions of Mr. Ghorbai.

 

On October 6, 2019, this Kurdish political prisoner was sentenced to 200 lashes as well as imprisonment by Branch 2 of the Criminal Court in Sanandaj on various charges.

 

Haidar Ghorbani was also tried in the First Branch of the Revolutionary Court in Sanandaj on charge of “armed rebellion against the Islamic ruler,” and was officially sentenced to death on Tuesday, January 28, 2020.
