Breathing in Confinement: On December 11, the Chief Justice of Isfahan Province announced the issuance of an indictment with the charge of ” Baghy ” against Amir Nasr-Azadani, a former professional footballer at Zob Ahan team in Isfahan  and Tractor team in Tabriz, as well as three other citizens. The three citizens have been identified as Soheil Jahangiri, Saleh Mirhashemi and Saeed Yaghoubi.

According to “Breathing in Confinement”, quoting Hamshahri Online, Amir Nasr Azadani, a former footballer at Tractor and Zob Ahan teams, has been accused of “Baghy”. Soheil Jahangiri, Saleh Mirhashemi and Saeed Yaghoubi are three other defendants of this case who are in danger of execution.

 

“On November 16, during the unrest in Isfahan, 3 security forces were killed and the accused persons were arrested. There are 9 defendants in this case and based on the indictment, Nasr Azadani is the fifth defendant. He has been in custody since November 18,” said chief Justice of Isfahan province.

 

Isfahan’s chief justice, without mentioning the identity of three other defendants, continued: “Amir Nasr Azadani is accused of Baghy. Via the membership in an organized armed group with the intention of confronting the Islamic Republic of Iran, he and 3 other defendants committed an armed riot on November 16. The videos recorded by the local cameras also show sufficient evidence that he has been in the armed group, and the indictment has been issued based on these facts”.

 

The case has led to the issuance of indictments and death sentences for these citizens while they have been denied the right to appoint their lawyers and have tried in flawed proceedings.

 

Amir Nasr-Azadani, 28, was a former professional footballer at Tabriz’s Tractor Sazi and Isfahan’s Zob Ahan teams.

 

It needs to be mentioned that Article 287 of the Islamic Penal Code approved in 2013 considers Baghy as a separate crime and its definition reads as follows: “A group that organizes an armed uprising against the essence of the Islamic Republic of Iran is considered guilty of Baghy and in case of using weapons, its members are sentenced to death.”

This is an absolute crime. In another word, it is not necessary for a result to have been achieve in order for the death sentence to be issued. Accordingly, merely because of using a weapon, even for shooting into the air, the crime has been committed and it is not necessary that someone having been injured or killed. The law article clearly states that the members of the group will be sentenced to death if they use weapons.
