Release from execution after 10 years of imprisonment in Mashhad

Breathing in Confinement: Being pardoned by the victim’s relatives, a prisoner who had previously been sentenced to death for murder was saved from execution.

According to Khorasan Daily, after 10 years in jail, a prisoner in Mashhad was released from execution with the consent of the victim’s family.

The case opened on September 28, 2010, when Mashhad police received a call by residents of Resalat 41 Street, reporting a fight in the area.

Police forces attended the scene and investigation began. The young victim was also transferred to Hasheminejad Hospital in Mashhad where he died.

Receiving the report, Judge Ali Akbar Safaeian, the Special Prosecutor for Murder Case, went to the hospital for further investigation. Field surveys indicated that the victim Hamid Gohari, a 24-year-old young man, had been attacked by some men, whom he previously had a conflict with. On the night of the incident also, the attackers were stalking him to ensure his place. Then they all entered the place and killed the victim.

With the judiciary’s order, detectives of Criminal Police in Khorasan Razavi came forward and arrested three fugitive defendants in March 2011.

Forensic investigators determined the cause of death to be an injury to the victim’s vital organ using a sharp object. One of the defendants named Abbas, 44, was suspected by the judge, but he plead not guilty saying that they went to that house just to reconcile with the victim.

Based on the available evidence as well as holding a swearing ceremony, the defendant was sentenced to death.

Being appealed by the defendant, the verdict issued by Branch 5 of the Criminal Court of Khorasan Razavi was referred to Branch 17 of the Supreme Court for further investigation. The Supreme Court, after studying the contents of the case, upheld the court’s decision for the execution of the defendant so that the case was sent to the Sentence Execution Deputy of Mashhad Public and Revolutionary Court.

For about 10 years, family members of the murderer unsuccessfully struggled to obtain the consent of the victim’s relatives. And finally “Abbas-Kh” went to the gallows despite being ready to pay more than a billion Tomans to be pardoned. The victim’s father, however, refused to forgive him. At the same time, the neighborhood’s elders, murderer’s relatives and the trustees of the city demanded the consent of the victim’s father and suddenly who all of a sudden invited them all to a large party and announced that he had pardoned the murderer. Hearing the news shocked Abbas at the gallows.

 

The consent memorandum was prepared at the presence of Judge Zargar and was later sent to Branch 5 of the Criminal Court in Khorasan Razavi for final decision to be made on the general aspect of the crime.
